Land Transfer of Ownership in Thailand: Legal Document Notary Services in Pattaya
Although foreign citizens cannot own land in Thailand outright, Thai law allows them to own structures and improvements built on the land. To protect their property rights, foreign nationals can take legal action, including utilizing legal document notary services in Pattaya for necessary documentation.
At J&E Concierge Pattaya, we simplify Thailand’s property ownership transfer process for foreign nationals. One popular method involves two agreements: a land lease agreement and a property sale-purchase contract. Another lesser-known option is acquiring surface rights from the landowner, either independently or alongside a contract. Thai law permits land leases for up to 30 years, with a renewal option for an additional 30 years.
To safeguard the foreign owner’s legal rights to the property, a formal sale-purchase agreement for the house or structure should be executed between the parties. Once ownership of the structure is secured, the owner can fully exercise their rights over the property.
If you’re navigating property transfers in Thailand, J&E Concierge Pattaya offers expert assistance every step of the way. For vacant land leases where foreign tenants intend to build, a building permit in the foreign owner’s name is required, and we’re here to ensure all legal documents are notarized in Pattaya to protect your interests effectively.

Comprehensive Support for Land Transfer of Ownership and Legal Document Notary Services in Pattaya
The building permit and sale-purchase agreement are essential documents in the land transfer process in Thailand. It’s important to understand that transfer fees in Thailand differ from those in other countries. If you’re buying property or need guidance with land transfer, J&E Concierge Pattaya offers expert assistance and legal document notary services in Pattaya.
Key Taxes and Fees for Land Transfer in Thailand
- Transfer Fee:
This tax, 2% of the total assessed property value, is typically shared between the buyer and seller but can also be paid solely by the buyer. - Business Tax:
Applicable for properties, this 3.3% tax comprises 3% business tax and 10% municipal tax based on the property’s sale price. - Stamp Duty:
Paid by the seller, this duty represents 0.5% of the property’s sale price. - Withholding Tax:
- For Companies: A 1% tax on the registered sale value or total assessed value.
- For Individuals: Calculated progressively based on the property’s assessed value.
Power of Attorney for Ownership Transfer
If you’re unable to be physically present during the property transfer, Thai law allows another person to act on your behalf via an ownership transfer power of attorney. This requires a notarized copy of the requester’s passport, which must be presented during the transfer. For notarization, our team provides reliable legal document notary services in Pattaya to ensure a smooth process.
Vehicle Registration and Renewal Services in Thailand
In Thailand, vehicles must be registered annually. Whether you own a car or motorbike, J&E Concierge Pattaya offers hassle-free assistance with Thai vehicle registrations.
Car Registration Renewal:
- Vehicles less than 5 years old require a simple renewal process.
- Vehicles older than 5 years must undergo a technical inspection at certified services with a blue-and-yellow logo. Inspections include checks on the vehicle number, lights, brakes, and exhaust. A certificate from the service is required for registration renewal.
Motorbike Registration Renewal:
- Motorbikes must be registered or renewed annually to ensure compliance with Thai law. Failure to renew may result in the inability to claim medical insurance in case of an accident.
