Under the law, even the smallest villa or apartment can be classified as a hotel. To successfully obtain a hotel license, you must follow certain steps.

According to the Ministerial Regulation of 2008, no application is required for operation in the following cases:
– on all floors of the building, it has no more than 4 rooms
– the total capacity is up to 20 people
– this is classified as a small enterprise that offers only the additional source of income for the owner
– daily rental activity is reported to the government
Also according to the Ministerial Regulation and hotels are classified in different types:
1. Hotels that are exempt from certain requirements, including obtaining a hotel business license
2. Those hotels that offer accommodation and the number of rooms does not exceed 50 and the size of one is not less than 8 square meters.
3. Hotels that offer services such as accommodation and catering services or restaurants and the size of a room is not less than 8 square meters
4. Hotels that offer accommodation, restaurants or catering services and the size of a room is not more than 14 square meters. In addition to these services, they also have conference rooms or entertainment rooms. Further, you will discover the steps necessary to obtain a permit to rent a room.
Entertainment facilities are only allowed if the hotels have more than 80 rooms and are located in entertainment areas or serve only food, alcohol and have opening hours after midnight.

By promoting the BOI, new investment is required, so an existing project is therefore not easy to promote.

If the building is outside the building control area, a building inspection certificate issued by a licensed civil engineer based on an engineer from the Thai state is required. According to the operating model of the hotel, it needs contractual arrangements.
