Starting a hotel business in Thailand is a very profitable thing among entrepreneurs eager to try something new. However, every person who decides to start such a business in this country must take into account the significant regulations of this state.
It is well known that a Thai citizen can register a company in any form of a commercial entity. However, for foreign citizens, the most recommended form is a private limited company.

Foreigners’ rights to own and operate a hotel business in Thailand are limited by the law on foreign affairs. To find out what the hotel license requirements are, we invite you to contact us and we will reveal all the necessary details and procedures.

Any foreigner who intends to start a hotel business in this country must obtain a business license from the business development department, these must be done before starting the activity and operation of the new business.

The licence requirements may be different depending on how your business will perform, and also the licence requirements may be special for certain products that the company will offer for sale to customers.

However, it is important to remember that a company that has Thai capital and its majority is a citizen of this country, the company will not face any restrictions.
That is why it is recommended for foreign nationals to form a partnership with a Thai citizen to meet the legal definition of a Thai company.
Therefore at least 51% of the shares of the new company must be owned by Thai citizens
In certain cases, foreigners may be exempted from certain requirements imposed by the FBA.

Hotel Licences Obtained

Those hotels that have 100 rooms or more and have investment capital of at least 500 million Baht are classified so that they do not benefit from taxes granted by the Investment Council.
Also, for certain projects and depending on its location, the BOI may allow foreigners to hold the majority of the shares in certain projects promoted when considered appropriate.

The number of licenses obtained before starting the business activity depends largely on the facilities and services provided by the hotel.

A hotel that has more than 4 rooms or can accommodate more than 20 people must obtain a license to operate a hotel business from the Provincial Administration Department for hotels located in Bangkok or in another case from the Provincial Governor’s office for others areas.

Hotel license requirements may be misunderstood for some of you, which is why we are here to clarify and make you understand how this work in Thailand.

If your hotel will provide catering services or restaurants you need a permit to sell food, liqueurs, and cigarettes.
A hotel that offers conference hall services or other entertainment venues must obtain an entertainment permit.
We mention again that any owner who intends to open a hotel in Thailand that has more than 4 rooms and hosts more than 20 people, regardless of whether this business is described as a pension, must request the registration of guesthouse licence, this is similar to the license for the hotel.

Before the accommodation provider fulfills those mandatory criteria to qualify for the appropriate licenses, the Thai law and regulations require certain conditions to be met.
All of this is required to run the business under Thai law.
In addition to the license for the rental room, the owners of these businesses are under intense control, especially to check if the normal functioning of such an enterprise is respected.

We find 4 different types of hotel licenses:

– for hotel services with up to 50 rooms

– for hotel and restaurant business

– for hotel rooms, restaurants but also seminars

for hotel rooms, restaurant, seminar rooms, and business and advertising

The licence requirements are:

– building permit

– interior map

– the owner’s documents

– map of the location where it is specified that there are no schools or temples around the hotel

– company documents

You have to keep in mind that you will not get a hotel license in a very short time. The estimated time until the documents are ready and you will be able to start the activity is 6 months.

Business Licences | Marriage Registration

Foreigners who are legally married to a Thai national may apply for a Non-immigrant O visa based on marriage in Thailand.
They will need the following documents for the extension for the visa:
-copy of your passport.
-copy of your Thai marriage certificate (both versions).
-copy of your Thai wife’s ID card.
-copy of your Thai wife’s Tabian Baan (House Papers).
-copy of a map to your residence in Thailand.
-copy of photos showing you and your wife together.
-copy of your bank book showing 400,000 THB in your bank account/copy of your income showing 40,000 THB per month in income.

    Hi I’m joanna from England and my husband and I own a villa here in Pattaya. We rent our villa out through an agent and have done so occasionally for the last year. It’s 3bed with a pool. We have been told that we need a “non-hotel” license to now legally do this at the cost of 200,000 THB. This is a large sum and I’ve googled it and simple cannot find any info about this. The office in our gated community have told us this and the property will be inspected too! Anyone heard of this? Thank you in advance

    My (Thai) wife and I (Farang) want to built or buy a hotel (50 rooms) in Thailand. We’re looking for some advise from experienced entrepreneurs who have taking this path before and learn from their experience. I am particularly interested in advise on the required licensing. I was advised that the “owner” does not need a license but that the license to operate can be held by the “general manager”, true?

    Now while I know what a homestay is, I’ve have no idea what sort of legal basis they operate on here and the differences between one and a hotel or indeed a hostel. Are they lightly to be affected by the clampdown on illegal hotels for instance?

    The question I have is: because each building only has 1 room, holding 2 people max, would It count as 10 separate buildings meaning no licence needed or would they be counted as 1 unit, meaning I will require a license. Any advice appreciated.
