How to Get a Hotel Licence
To apply for a hotel business licence there are several things you need to do:

What is a hotel?
A Hotel Business Licence application is only required if the business qualifies as a hotel under the ‘Hotel Act Thailand’. A hotel business is defined as:
- A place of accommodation available for rental for a duration of less than 1 month.
- Your Hotel, Villa or Apartment has a capacity of more than four rooms and can accommodate more than twenty guests.
What classification is your hotel
Under government hotel regulations, hotels are classified as follows:
- Type 1: A hotel providing accommodation only, the number of rooms does not exceed fifty, the size of each room is not less than eight square meters,
- Type 2: A hotel providing accommodation and catering or restaurant services, the size of each room is not less than eight square meters
- Type 3: A hotel providing accommodation, catering or restaurant services, the size of each room is not less than 14 square meters, and which has either conference rooms or entertainment venues which under the Place of Service Act could be a place for dancing, bars, and nightclubs or spa
- Type 4: A hotel providing accommodation, catering or restaurant services, conference rooms, and entertainment venues, the size of each room is not less than 14 square meters.
For Type 3 and 4 hotels, no entertainment venues will be allowed unless these hotels have more than 80 rooms, are located in entertainment areas, or serve food, alcohol or entertainment only, and have opening hours after midnight.

For a hotel with more than 80 rooms, or depending on its size or location, an Environment Impact Assessment (EIA) is required. permit, a license from the local administration official must be obtained. If the restaurant has an area less than 200 square meters, the owner must only notify the local authorities for a Certificate of Notification as stated in the Public Health Act.
Permit for Occupation
To obtain the hotel licence you will also need a “Permit for Occupation” or a “Certification of Building Inspection” depending on the area where your hotel is located.

Hotel Licence Validity
The Hotel Business License is valid for five years.
Airbnb villas houses and condos rentals is a little bit unclear. Villa’s or Apartments are classed as hotels id “Hotel, Villa or Apartment has a capacity of more than four rooms in total or exceeds more than twenty guests”. You cannot justify not having a business licence based on the fact that every single unit/room is under the permitted capacity if you have more than 4 rooms/apartments in the one condo.
