How to Get a Hotel Licence
To apply for a hotel business licence there are several things you need to do:
Is your business classified as a hotel?
What do we mean by the hotel?
A license application for hotel business is required only if the business qualifies as a hotel based on “Hotel Act Thailand”. The hotel business means:
- A place of accommodation available for rental for a duration of less than 1 month.
- Your Hotel, Villa or Apartment has a capacity of more than four rooms and can accommodate more than twenty guests.
What classification is your hotel
Under government hotel regulations, hotels are classified as follows:
- Type 1: It offers accommodation, and the number of rooms does not exceed fifty and the size of each room should not be less than eight square meters.
- Type 2: It offers accommodation, catering and restaurant services, and the size of each room should not be less than eight square meters.
- Type 3: It offers accommodation, catering and restaurant services, and the size of each room should not be less than 14 square meters. It can have conference rooms and entertainment rooms.
- Type 4: It offers accommodation, catering and restaurant services, conference rooms and entertainment venues, and the size of each room should not be less than 14 square meters.
For hotels with types 3 and 4, entertainment spaces are allowed only if the hotels have more than 80 rooms, are located in entertainment areas and serve only food, alcohol, and opening hours are after midnight.
Does your Hotel Comply with Business Licence regulations?
There a lot of legal condition you must comply to before you will be able to successfully apply for a Hotel Business Licence. The location of the hotel, the facilities you have, how big the rooms are, the type of structure, and a whole load of health and safety issues and environmental laws all these must be adhered to before a hotel licence can be issued in Pattaya.
Other Licences required for your hotel
Environment Impact Assessment
The hotel that has more than 80 rooms and depending on the size, or even its location, is required an environmental impact assessment (EIA), implicitly, an authorization.
If the restaurant has an area of less than 200 square meters, the owner must notify the local authorities through a notification certificate.
Permit for Occupation
To obtain the hotel licence you will also need a “Permit for Occupation” or a “Certification of Building Inspection” depending on the area where your hotel is located.
Additional licenses are required for food, liquor, entertainment and more. see Pattaya Business Licensing
Hotel Licence Validity
The Hotel Business License is valid for five years.
Airbnb villas houses and condos rentals is a little bit unclear. Villa’s or Apartments are classed as hotels id “Hotel, Villa or Apartment has a capacity of more than four rooms in total or exceeds more than twenty guests”. You cannot justify not having a business licence based on the fact that every single unit/room is under the permitted capacity if you have more than 4 rooms/apartments in the one condo.
