The work permit in Thailand is the legal document you need to occupy a job in this country and which mentions the position and job description. But to get a work permit in Thailand, and you are a foreign citizen, first of all, you will need to obtain a non-immigrant visa. Depending on the type of visa and your nationality, you can obtain a non-immigrant visa either from your country of origin or from Thailand.
When you want to start working for a company in Thailand, both you and the respective company will have to meet certain requirements.
If the company you are going to start working for is registered in Thailand, and it wants to obtain your specific work permit and you are a foreign citizen, this company must have a capital of at least 2 million Baht.
Is it easy to get Work Permit in Thailand?
As the employee for whom the company wishes to obtain a work permit and is married to a Thai national, she needs capital of at least 1 million Baht. If the company you want to work for is not registered in Thailand, it is required to have a minimum capital of 3 million Baht.
Before a company hires a citizen of another nationality, it is obliged to have 4 Thai employees, and it is allowed a maximum of 10 work permits. When a company is promoted by the Investment Council or by the BOI, it must not meet any of the requirements mentioned above. The company can hire 4 foreign nationals without having to meet capital requirements and it does not count the number of Thai nationals within it.
But this rule can also be applied only when the employee of a foreign nationality fulfills, in turn, the requirements imposed by the BOI and can specify the reason why the respective company needs this employee within it.
If you want to get a work permit in Thailand you will have to meet the following requirements:
– either you will be hired by a company that meets all the requirements mentioned above, or you start a new business by registering a new company in Thailand respecting the same requirements
– the position you will occupy in the respective company will have to be a job that you can legally activate in Thailand
– have a non-immigrant visa
– you will not have the right to have more jobs
– you have the skills for the job you want to occupy, you have at least a bachelor’s degree but also work experience
– you must not suffer from certain serious or dependent diseases

The company you want to work for must submit the following documents:
– first of all, the company registration certificate
– list of all shareholders of the company certified by the Commercial Registration Department
– if necessary, a factory license certified by the Department of Factory within the Ministry of Industry
– VAT certificate
– VAT registration
– also withholding tax
– payment of social security
– your employment contract that indicates its position, salary, and duration but also the duties that you will have to fulfill
All these documents must be stamped with the company seal on each page, and the directors and managers must sign their names near the seal.
You will need to provide the following documents:
– passport along with its copies, signed by you
– Non-immigrant visa and copy thereof
– your departure card
– bachelor’s or university diplomas and their transcription
– CV summary
– 3 photos that were taken in the last months
– in case you are married to a Thai citizen, you will have to present the marriage certificate
– a medical certificate that has been issued in the last 30 days
All these documents mentioned above are mandatory, and next to them you need their copies along with your signature. There are cases where officers may request that some of these documents be translated into Thai and notarized by your Embassy.
When you have been employed by a company and you are going to work for it, or if you have a company and you want to hire someone, you have to go to the Ministry of Labor and apply for a work permit or company for who you will work will apply for this permit. The next step is to extend the visa from the time you have at the moment to a period of 1 year or 2 years.
If the company you work for is promoted by the BOI or you have hired a foreign citizen to work for your company, and this is promoted by the BOI, the work permit and the visa extension are requested through the BOI expertise system.
When you have to renew your work permit you will have to comply with the same requirements as the first time and you will also go through a similar approval process.
The difference is that when you first obtained your work permit you also obtained a 1 or 2-year extension visa, so you will not need to renew your visa every 90 days.
